TERMS OF USE
1. ELECTRONIC MEDIA
1.1 Please note that (a) the domain name Hound Mobility (the "Website"); and (b) the software application for use on smartphones, tablets, desktops, or laptops ("Application") (collectively referred to as the "Electronic Media") is owned, managed, and operated by Elitemiles Pvt Ltd, a private limited company incorporated in accordance with the laws of India (hereinafter referred to as the "Company" or "Hound Mobility").
2. LEGAL AGREEMENT
2.1 These Terms of Use govern the use of the Electronic Media and Services offered by Hound Mobility and constitute a binding agreement between the Company and the User.
2.2 These terms are to be read in conjunction with all Company policies, including but not limited to our Privacy Policy, Cancellation Policy, and Booking Policy. Continued use of the platform implies acceptance of all updated policies.
2.3 If you do not agree to these Terms, do not use our platform or services.
2.4 The Company reserves the right to modify or update these Terms of Use at any time without notice.
2.5 Users are responsible for reviewing the Terms periodically. Continued use constitutes acceptance of any changes.
3. DEFINITIONS
All the defined and capitalized terms in these Terms of Use will have the meaning assigned to them here below:
- 3.1 "Account" shall mean the account created by the User on the Electronic Media for availing the Services provided by the Company.
- 3.2 "Additional Fee" shall mean such fee as may be charged additionally, while availing the Services for the Ride from third-party providers, towards consumption of any additional services like Wi-Fi services, partner service provider's services, food items, water, beverages, etc.
- 3.3 "Applicable Law(s)" shall mean and include all applicable statutes, enactments, acts of the legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any governmental authority, tribunal, or court of India.
- 3.4 "Application" shall mean the website https://houndmobility.in and/or the mobile application operated by the Company, as updated from time to time.
- 3.5 "Hound Mobility" or "us" or "we" or "our" shall mean Elitemiles Pvt Ltd, a company incorporated under the provisions of the Companies Act, 2013 and operating under the brand name Hound Mobility.
- 3.6 "Force Majeure Event" shall mean any event arising due to any cause beyond the reasonable control of the Company.
- 3.7 "Location Fee" shall mean and include without limitation any toll duty, inter-state taxes, airport charges, or any other charge/fee imposed by governmental authorities or third parties with regard to the operation of the Vehicle at specific locations.
- 3.8 "Registration Data" shall mean and may include the present, valid, true, and accurate name, email ID, phone number, and such other information as may be required by Hound Mobility from the User from time to time for registration on the Application.
- 3.9 "Ride", "Booking", and "Trip" shall mean the travel in the Vehicle by the User facilitated through the Electronic Media.
- 3.10 "Total Ride Fee" shall mean and include the aggregate amount reflected in the Electronic Media or notified to the User as an amount payable towards transportation services and the Services provided through the Electronic Media including, inter alia, the Location Fee, the Additional Fee (as applicable), and any other fee as may be notified by Hound Mobility in the Electronic Media or through the booking method for each User, inclusive of applicable taxes.
- 3.11 "Terms of Use" shall mean these terms and conditions for the User.
- 3.12 "User/You" means a person who has an Account on the Website or Application.
- 3.13 "Vehicle" shall mean a four-wheeler electric automobile as defined under the Motor Vehicles Act, 1988.
- 3.14 "Website" shall mean the Application and the domain name https://houndmobility.in or any other domain or software as may be specified by the Company from time to time.
4. REGISTRATION AND ACCOUNT
4.1 The User hereby understands and acknowledges that he/she has attained at least 18 (eighteen) years of age and is competent to contract under the Applicable Law(s) and thereby may register on the Electronic Media after complying with the requirements of this Clause 4 and by entering their Registration Data.
4.2 The User shall ensure that the Registration Data provided by him/her in the Account is accurate, complete, current, valid, and true, and is updated from time to time. Hound Mobility (Elitemiles Pvt Ltd) shall bear no liability for false, incomplete, outdated, or incorrect Registration Data provided by the User.
4.3 The User is solely responsible for maintaining the confidentiality of his/her Registration Data and will be liable for all activities and transactions that occur through the User's Account, whether initiated by the User or any third party. The User shall not authorize any third parties to use his/her Account. The Account cannot be transferred or assigned to a third party. Hound Mobility shall not be liable for any third-party claim or loss resulting from unauthorized use of the User's password or Account.
4.4 Hound Mobility reserves the right to suspend or terminate the User's Account with immediate effect and for an indefinite period if it has reason to believe that the Registration Data or any other data provided by the User is incorrect or false, or that the security of the User's Account has been compromised in any way, or if there is a breach of these Terms of Use or unauthorized use of the Account by any third party.
4.5 The Company allows each User to open only one Account in association with the provided Registration Data. In case of any unauthorized use of the User's Account, please immediately inform us at support@houndmobility.in.
4.6 If the User is unable to access his/her Account, he/she must inform the Company at support@houndmobility.in and submit a written request to block the Account. Hound Mobility shall not be liable for any unauthorized transactions made through the User's Account prior to 72 (seventy-two) hours after receiving such a written request. No liability shall arise in the event of a Force Majeure Event.
4.7 Hound Mobility reserves the right to modify, terminate, or suspend Services to any User at any time without prior notice due to internal policy changes, Applicable Laws, or any breach of these Terms of Use. All previous bookings or service requests may be voided without any refund or further deliverables.
5. USER CONTENT
5.1 Except for the Registration Data or any other data provided, posted, uploaded, or submitted by the User on the Electronic Media while using any of the services offered through the platform, the Company does not wish to, and the User should not, send any confidential or proprietary information to the Company via the Electronic Media or through any other means, unless required by Applicable Laws.
5.2 Hound Mobility shall be entitled to process, store, and transfer the User's information as and when it deems appropriate, in accordance with its Privacy Policy and as permitted by Applicable Law.
5.3 The User agrees to grant Hound Mobility a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise all rights including copyright, publicity, database rights, and any other intellectual property rights that the User may have in the content or data submitted by them, in any format or media now known or hereafter developed. THE USER EXPRESSLY AGREES AND PERMITS HOUND MOBILITY TO SHARE SUCH USER INFORMATION in accordance with the Privacy Policy and Applicable Laws, including with third-party partners and service providers where such sharing is necessary for delivering services or enhancing user experience.
6. PRIVACY
6.1 When you become a User of Hound Mobility, and throughout your use of our Electronic Media and/or Services, you will provide us with certain personal and non-personal information that may or may not be publicly available. We are committed to respecting the privacy and security of your data in accordance with our Privacy Policy, which is available on our Website at www.houndmobility.in (or will be shared upon request).
We will collect, use, disclose, store, and process your data strictly in accordance with our Privacy Policy. By continuing to access and use our Electronic Media and/or Services, you consent to the collection and use of your information as outlined therein.
We will only share your data with third parties, partners, or affiliates as required to provide you with our Services or as specified in our Privacy Policy, and always in compliance with applicable data protection laws.
7. USE OF ELECTRONIC MEDIA
7.1 The User agrees, undertakes, and confirms that their use of Hound Mobility's Electronic Media shall be strictly governed by the following binding principles:
7.1.1 The User shall not use any "deep-link," "page-scrape," "robot," "spider," or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any part of the Electronic Media or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Electronic Media. Attempting to obtain any materials or information not intentionally made available through the Electronic Media is strictly prohibited. Hound Mobility reserves the right to block or take action against such activity.
7.1.2 The User shall not probe, scan, or test the vulnerability of the Electronic Media or any network connected to it, nor breach any security or authentication measures. The User may not reverse look-up, trace, or attempt to trace any information of any other User or visitor to the Electronic Media, or exploit any Service for any reason other than accessing their own information.
7.1.3 The User shall not use the Electronic Media in a manner that could damage, disable, overburden, or impair Hound Mobility's servers or connected networks. Unauthorized access attempts via hacking, password mining, or any other means are strictly prohibited.
7.1.4 The User shall not reverse engineer, decompile, or disassemble any part of the software or systems used to provide the Services.
7.1.5 By registering an Account, the User authorizes Hound Mobility to contact them via phone call, SMS, or email on their registered contact details for communications related to rides, services, offers, feedback, or customer support.
7.1.6 The User shall not advertise to, solicit, or otherwise contact other Users of the Electronic Media for commercial purposes. Any use of information obtained through the platform to harass, abuse, or harm another person is a direct violation of these Terms.
7.1.7 Hound Mobility reserves the right to disclose any User information (including identity) when required to do so by law or by valid governmental request. The User expressly authorizes Hound Mobility to cooperate with law enforcement in case of suspected criminal activity, including sharing relevant User data.
7.1.8 Hound Mobility is not responsible for the behavior of other Users, including hackers or unauthorized actors, who may post offensive material or obtain and misuse personal information. Users are advised to use caution when sharing personal data on any public area of the Electronic Media.
7.1.9 Hound Mobility reserves the right to take legal action and claim damages for any disruption or hindrance caused to its Services—whether intentional or unintentional—by a User or group of Users.
8. SERVICES
8.1 The Service allows the User to send a ride request through Hound Mobility's Electronic Media. Hound Mobility reserves the sole discretion to accept or reject any such request. Upon acceptance, the User will be notified and provided with relevant details of the assigned Driver, including the Driver's name, contact number, and any other details as deemed necessary by the Company.
8.2 Hound Mobility shall make reasonable efforts to connect the User with an available Driver, subject to the availability of a Vehicle and Driver in the vicinity of the User at the time of the request.
8.3 By using the Application or the Service, the User agrees and undertakes that:
8.3.1 The Service and Application will be used solely for the User's personal, non-commercial purposes and shall not be sold, assigned, or otherwise transferred to any third party.
8.3.2 The User shall not use any Account that belongs to or is registered under another person, without explicit authorization.
8.3.3 The Service or Electronic Media will not be used for any illegal or unlawful purposes, including the transport of prohibited items, contraband, or hazardous substances as defined under Applicable Law.
8.3.4 The User shall not harm, threaten, or interfere with the Driver, Vehicle, Electronic Media, or any of Hound Mobility's systems or infrastructure in any way.
8.3.5 The User shall comply with all Applicable Laws of India, including local, state, and central laws relevant at the time and place of ride usage.
8.3.6 The User shall comply with the provisions of the Information Technology Act, 2000, and all applicable rules and regulations made thereunder.
8.4 Hound Mobility reserves the right to suspend or immediately terminate the Service and/or the User's access to the Electronic Media in the event of any non-compliance with the above-mentioned terms.
8.5 The User shall not engage in any of the following actions while using the Service, including but not limited to: smoking or consuming alcohol inside the Vehicle, misbehaving or verbally/physically abusing the Driver, tampering with promotional materials inside the Vehicle, distracting the Driver, making loud noises, attempting to exit the Vehicle during motion, damaging Vehicle interiors, igniting fire, or engaging in any other activity that is unlawful or prohibited.
8.6 In the event the User is found engaging in any of the aforementioned activities, Hound Mobility reserves the right to impose a penalty and terminate the Ride or permanently disable the User's Account without further notice.
8.7 If the User fails to pay the imposed penalty after completion of the Ride, Hound Mobility shall be entitled to recover such dues in accordance with Applicable Law. This includes recovering losses, damages, costs, or expenses incurred by the Company and/or any third-party service providers arising due to such actions or omissions of the User. Hound Mobility may also blacklist the User, resulting in permanent suspension of the User's Account.
9. PAYMENT
9.1 The User will be charged the Total Ride Fee by Hound Mobility for each Ride, covering the transportation services and any other Services availed by the User through the Electronic Media.
9.2 In addition to the Total Ride Fee, the User may be charged a Location Fee, which includes charges such as tolls, inter-state taxes, airport entry/exit fees, or any other government-imposed or third-party fees related to the operation of the Vehicle at specific locations. The User acknowledges and agrees that these charges may be revised from time to time at the sole discretion of Hound Mobility. Any such revisions will be duly reflected on the Electronic Media or through the booking interface used by the User.
9.3 If the User opts for cash payment at the time of booking, the Total Ride Fee shall be paid directly to the Driver at the end of the Ride.
9.4 Hound Mobility shall issue a receipt or acknowledgment to the User at the end of each Ride. The User may also download or request a copy of the invoice from their account section on the Electronic Media.
9.5 Hound Mobility reserves the right to levy reasonable charges for cleaning or repairing the Vehicle in case of any damage or mess caused by the User during the Ride. These costs may be collected on behalf of the Vehicle owner or Third Party Provider. The User shall be fully responsible for such charges if the condition of the Vehicle, after the Ride, exceeds what is considered normal wear and tear.
9.6 Any issues related to payment processing, excluding those arising from errors or faults in Hound Mobility's Application or Website, shall be resolved between the User and the relevant Payment Gateway or Payment Processor. Hound Mobility shall not be liable for any unauthorized transactions carried out through the User's E-Wallet, Credit Card, Debit Card, UPI, or Net Banking during or after use of the Services.
9.7 If Hound Mobility has reasonable grounds to suspect that any payment transaction initiated through the User's Account is fraudulent, the Company reserves the right to suspend the Account and restrict access pending a detailed investigation. The suspension shall continue until the investigation is concluded and appropriate action is determined.
10. ADVERTISEMENT AND LINKS
10.1 Hound Mobility may, from time to time, send promotional emails, SMS messages, or push notifications to the User regarding its services, offers, updates, or relevant content aimed at enhancing the User's experience.
10.2 Hound Mobility reserves the right to reject, restrict, or disallow the use of any third-party services, tools, or integrations that the User attempts to use in conjunction with Hound Mobility's Electronic Media, at its sole discretion and without prior notice.
11. CUSTOMER RELATIONSHIP MANAGEMENT
11.1 All issues, suggestions, feedback, questions, and concerns arising while availing Hound Mobility's Services shall be communicated directly to us via email at support@houndmobility.com.
11.2 Any issue must be reported within 7 (seven) days from the occurrence of the issue. Failure to do so will result in the issue not being entertained. The User agrees and acknowledges that all complaints, grievances, or queries must be formally communicated to Hound Mobility only through our official Electronic Media or customer support email, as mentioned herein, and not through any third-party platform or social media channels.
11.3 The User shall be solely responsible for any false allegations or misleading representations made against Hound Mobility on third-party platforms or social media. Hound Mobility shall not be liable to respond to or resolve any such issues raised outside the official communication channels.
12. INDEMNIFICATION
In addition to, and not in limitation of, any specific indemnities provided by You under these Terms of Use and/or any policies of Hound Mobility, You agree to indemnify, defend, and hold harmless Hound Mobility Private Limited, its affiliates, directors, officers, employees, consultants, agents, shareholders, representatives, contractors, and users (collectively, the "Indemnified Parties") from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees and expenses, and interest thereon) arising out of or in connection with:
(a) any breach, non-performance, or non-compliance by You of these Terms of Use and/or any other terms and conditions applicable to the use of the Electronic Media or Services;
(b) the truthfulness and accuracy of the information or Registration Data provided by You during Account creation or while availing Services;
(c) any claim made by the Driver or Third Party Providers relating to Your interaction, communication, transaction, dispute, or conduct with them;
(d) any content, material, or information posted, submitted, or otherwise transmitted by You through the Electronic Media, or Your misuse or unauthorized use of the Services;
(e) any claim by any third party arising out of or relating to Your use of the Electronic Media or availing of the Services;
(f) any breach by You of third-party rights, including but not limited to defamation, invasion of privacy, or infringement of intellectual property rights.
13. LIABILITY
13.1 The information, recommendations, and/or Services provided to the User on or through Hound Mobility's Electronic Media, including the Website, Application, or Customer Support Centre, are intended solely for general informational purposes and do not constitute professional advice. While Hound Mobility shall make reasonable efforts to keep the Electronic Media and its contents accurate, complete, and up to date, Hound Mobility does not guarantee that the Electronic Media is error-free, defect-free, or free from malware or viruses, nor that its contents are always accurate or current.
13.2 Hound Mobility shall not be liable for any missed flights, trains, events, appointments, or any form of delay. The User is responsible for planning and booking Rides in accordance with local traffic, weather conditions, public events, vehicle breakdowns, and other unforeseeable delays which are beyond the control of Hound Mobility.
13.3 Hound Mobility is not responsible for any damages resulting from the use or inability to use the Electronic Media. This includes, without limitation, issues due to incorrect usage, dialling the wrong customer care number, network interruptions, software bugs, malware, or viruses.
13.4 The User shall be solely responsible for their personal belongings and luggage. In the event of lost items within a Vehicle, Hound Mobility will attempt to recover such items on a best-effort basis but shall not be held liable for any loss or damage. Any complaint or report regarding lost property or service dissatisfaction must be made within 24 (twenty-four) hours of the Ride. If the item is recovered, Hound Mobility will communicate further steps to the User for retrieval.
13.5 Hound Mobility does not guarantee uninterrupted availability or sustainability of the Services and disclaims all responsibility for interruptions due to technical or operational limitations.
13.6 Hound Mobility will not be responsible for any failure to communicate updates, offers, Ride statuses, or other relevant information due to incorrect or outdated mobile numbers, email addresses, or other contact details provided by the User.
13.7 IN NO EVENT SHALL HOUND MOBILITY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, including without limitation, damages for loss of use, data, profits, or goodwill, whether arising in contract, tort, negligence, strict liability, or otherwise, even if Hound Mobility has been advised of the possibility of such damages.
13.8 TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, HOUND MOBILITY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS OF USE SHALL NOT EXCEED INR 1,000/- (RUPEES ONE THOUSAND ONLY).
13.9 If any Applicable Law restricts the limitation or exclusion of liability as stated herein, the scope of such exclusions or limitations shall be interpreted to the minimum extent permitted under such Applicable Law.
14. INTELLECTUAL PROPERTY OWNERSHIP
14.1 Hound Mobility (and its licensors, where applicable) shall exclusively own all rights, titles, and interests, including all intellectual property rights, in and to the Electronic Media and the Services. This includes, without limitation, any suggestions, ideas, enhancement requests, feedback, recommendations; as well as all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and any other content or information provided by the User or any third party in connection with the Electronic Media or the Services.
14.2 Third-party trademarks, logos, or brand names may appear on the Electronic Media. All such rights are the property of their respective owners. The use of any third-party intellectual property by the User without prior written consent from the rightful owner is strictly prohibited. Hound Mobility does not authorize or grant any rights to the User for such third-party intellectual property.
14.3 These Terms of Use do not constitute a sale or transfer of ownership and do not convey to the User any rights of ownership in or related to the Electronic Media, the Services, or any intellectual property rights held by Hound Mobility. The User shall be solely liable for any violations of laws or infringements of third-party intellectual property rights arising from the misuse of the Services or the Electronic Media.
15. APPLICABLE LAW AND DISPUTE RESOLUTION
15.1 These Terms of Use shall be governed by and construed in accordance with the laws of India, without reference to any conflict of law principles.
15.2 Any disputes or differences arising out of or in connection with these Terms of Use shall first be attempted to be resolved amicably through good-faith negotiations between senior representatives of Hound Mobility and the User.
15.3 If such dispute is not resolved amicably within a period of sixty (60) days from the date of initiation of discussions, the same shall be referred to and finally resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator appointed by Hound Mobility.
15.4 The seat and venue of arbitration shall be Kochi, Kerala, and the arbitration proceedings shall be conducted in English. The award passed by the arbitrator shall be final, binding, and enforceable in accordance with applicable law.
15.5 Each party shall bear its own costs in relation to the arbitration proceedings unless otherwise directed by the arbitrator.
16. TRAVELLING WITH PETS
16.1 A maximum of two (2) pets are permitted per Ride, subject to vehicle capacity and prior intimation to the driver.
16.2 Pets must be secured in appropriate carriers or suitably restrained at all times during the Ride to ensure safety and hygiene for both the pet and the occupants.
16.3 The User shall be fully liable for any damage caused by the pet(s) to the Vehicle or its fittings. In such cases, the cost of repair, cleaning, or replacement as assessed by Hound Mobility shall be payable by the User in full.
17. GENERAL
17.1 Hound Mobility shall not be liable for any infringement of copyright, trademark, patents, and/or any intellectual or proprietary rights of any third party arising from content and/or materials posted on or transmitted through the Electronic Media or items advertised thereon.
17.2 We shall have no liability to the User for any failure or delay in the performance of Services or any interruption in access to the Electronic Media, where such failure or delay is due to circumstances beyond our reasonable control. In such events, the time for performance shall be extended accordingly. Granting any indulgence under these Terms of Use shall not constitute a waiver of any of our rights.
17.3 These Terms of Use, along with Hound Mobility's Privacy Policy and other applicable policies referenced herein, constitute the entire agreement between the User and Hound Mobility. They supersede all prior or contemporaneous communications, understandings, or agreements, written or oral, relating to the subject matter herein.
17.4 Any provisions of these Terms of Use that, by their nature, should survive termination or expiration (including, without limitation, indemnities, warranties, disclaimers, and limitations of liability) shall remain in full force and effect.
17.5 If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
17.6 No representation by any employee, officer, or agent of Hound Mobility, or any content published on the Electronic Media, shall be construed as amending or adding to these Terms of Use unless specifically agreed to in writing and signed by a duly authorized director of the Company.
17.7 The User shall not assign, transfer, or novate any of their rights or obligations under these Terms of Use without the prior written consent of Hound Mobility.
17.8 These Terms of Use shall be governed by and construed in accordance with the laws of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala, India.
17.9 Failure on the part of Hound Mobility to exercise or enforce any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
17.10 These Terms of Use do not constitute any partnership, joint venture, agency, or employer-employee relationship between the User and Hound Mobility.
17.11 Any notice or communication to the User may be served by email or postal mail. In the case of:
- Email, it shall be deemed delivered at the time of sending, provided no delivery failure notification is received;
- Postal mail, it shall be deemed delivered five (5) business days after dispatch.
17.12 These Terms of Use are for the benefit of the User only. No third party shall have any rights to enforce any of the terms herein.
17.13 By registering with Hound Mobility, the User consents to receive marketing and promotional communications via email, SMS, and other channels. Users can opt out as specified in the Privacy Policy.
17.14 The invalidity or unenforceability of any one provision shall not affect the enforceability of the remaining provisions. If a provision is deemed unenforceable, a valid provision reflecting the intent of the parties shall be substituted.
17.15 The User may contact Hound Mobility via email at support@houndmobility.com for any questions, complaints, or support requests.
17.16 Hound Mobility shall not be held liable for any failure to perform its obligations under these Terms of Use if such failure is due to a Force Majeure Event, and performance shall be suspended for the duration of such event.
